By accessing and using the CRM Portal, the user (hereinafter, "the User" or "Licensee") agrees to be bound by these terms.
2. Nature of the Service and License Grant
The Service provides licensed, non-exclusive access to a Software as a Service (SaaS) application designed for Customer Relationship Management, specifically tailored for vehicle storage and related operations.
Grant of License: Access to the CRM Portal is granted only to authorized individuals or entities under a separate, pre-existing service agreement with the Service Provider. This access constitutes a non-transferable, revocable license to use the software functionalities; it does not constitute a sale or transfer of ownership of the software itself.
3. Intellectual Property (IP) and Ownership
The entire content, structure, design, source code, visual elements, databases, and underlying technology of the CRM Portal are the exclusive property of the Service Provider or its licensors.
The User agrees not to:
Copy, modify, decompile, or reverse engineer any part of the Service.
Use the Service’s intellectual property for any unauthorized commercial purpose.
4. Data Responsibility and Integrity
The Service provides the platform for managing vehicle storage data, client records, and operational information.
User Data Ownership: The User retains full ownership and responsibility for all data, text, files, and information uploaded to or generated within the CRM Portal (collectively, "User Data").
Data Accuracy: The User is solely responsible for the accuracy, completeness, legality, and reliability of all User Data entered into the Service. The Service Provider is not liable for errors or omissions in User Data.
5. Disclaimer of Warranties and Service Availability
The CRM Portal is provided on an "as is" and "as available" basis.
The Service Provider does not warrant that:
The Service will meet the User’s specific requirements.
The Service will be entirely uninterrupted, timely, secure, or error-free.
The results obtained from the use of the Service will be accurate or reliable.
The Service Provider shall not be liable for any downtime, loss of data, or operational failures arising from internet outages, external hardware issues, or scheduled maintenance.
6. Governing Law and Jurisdiction
These terms shall be governed by and construed in accordance with the laws of [STATE OR COUNTRY, e.g., Australia/New South Wales]. The parties agree to submit to the exclusive jurisdiction of the courts of [CITY/REGION] for the resolution of any disputes.
